1. Acceptance of Terms
By accessing and using the Africhama CHAMA CHAMA Management System ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Africhama CHAMA provides an online platform for managing Savings and Credit Cooperative Organization (CHAMA) operations, including but not limited to:
- Member registration and account management
- Contribution tracking and processing
- Loan application and management
- Fine calculation and payment
- Financial reporting and statements
3. Membership Eligibility
To become a member and use the Service, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Agree to the CHAMA's constitution and by-laws
- Pay all required registration fees and contributions
4. Member Obligations
As a member, you agree to:
- Make regular weekly contributions as stipulated by the CHAMA
- Pay any fines assessed for missed contributions or other violations
- Repay loans according to agreed terms and schedules
- Keep your account information and contact details up to date
- Maintain the confidentiality of your login credentials
- Not share your account access with unauthorized persons
5. Contributions and Payments
Members are required to make weekly contributions as determined by the CHAMA. Failure to meet minimum contribution requirements may result in fines as specified in the CHAMA constitution. All payments are processed through approved channels including M-Pesa and bank transfers.
6. Loans
Loan applications are subject to approval based on the CHAMA's lending policies. Approved loans must be repaid according to the agreed schedule. Failure to repay loans may result in additional interest charges, legal action, and reporting to credit reference bureaus.
7. Fines and Penalties
The CHAMA may impose fines for various infractions including but not limited to:
- Missing weekly contribution deadlines
- Late loan repayments
- Meeting attendance violations
- Other violations as specified in the CHAMA constitution
8. Account Security
You are responsible for maintaining the security of your account credentials. You must immediately notify us of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account due to your failure to protect your credentials.
9. Data Protection
Your personal data is processed in accordance with the Kenya Data Protection Act, 2019 and our Privacy Policy. By using the Service, you consent to the collection and processing of your personal data as described in the Privacy Policy.
10. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the property of Africhama CHAMA or its licensors and are protected by intellectual property laws.
11. Limitation of Liability
To the fullest extent permitted by law, Africhama CHAMA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
12. Service Availability
We strive to ensure the Service is available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or other operational reasons.
13. Termination
Membership may be terminated:
- By the member upon written notice and settlement of all obligations
- By the CHAMA for violation of these terms or the CHAMA constitution
- By the CHAMA for non-payment of contributions for an extended period
14. Dispute Resolution
Any disputes arising from these terms shall first be resolved through internal CHAMA grievance procedures. If unresolved, disputes shall be referred to arbitration in accordance with the laws of Kenya.
15. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya, including the Co-operative Societies Act and the CHAMA Societies Act.
16. Changes to Terms
We reserve the right to modify these terms at any time. Members will be notified of significant changes through the Service or via email. Continued use of the Service after changes constitutes acceptance of the modified terms.
